Terms of Service

§ 1 Operator, brand owner, and acceptance
(1) The website and platform Project Mega Pack (the “Service”) at projectmegapack.com and related subdomains is operated by

(the “Operator”).
(2) Riverbed LLC (United States) is the brand owner of Project Mega Pack and holds the intellectual property. The Operator runs the Service under a contractual licence. Riverbed LLC may access Service data, including payment-related records via our payment service provider, as described in our Privacy Policy.
(3) By accessing or using the Service, you agree to these Terms of Service (“Terms”), our Privacy Policy, and — where applicable — additional agreements referenced below. If you do not agree, do not use the Service.
(4) Mandatory consumer rights under applicable law remain unaffected.
§ 2 Service description
(1) The Service lets users discover, browse, and download Microsoft Flight Simulator (MSFS) liveries and curated livery packs, optionally create an account, subscribe to a Supporter Plan, purchase Ad Credits, upload liveries as a creator, or run advertising campaigns.
(2) The Service is provided digitally. Availability, catalog content, and features may change. We do not guarantee uninterrupted access, specific download speeds, or compatibility with every MSFS edition, simulator version, or third-party aircraft add-on.
(3) Liveries and packs are community or staff-curated content. Unless expressly stated, the Operator does not claim ownership of user-uploaded liveries.
§ 3 Eligibility, age, and accounts
(1) You must be at least 16 years old to register an account.
(2) Paid features (Supporter Plan, Ad Credits, and related checkout) require you to be 18 years or older, or to use the Service under the supervision and with the consent of a parent or legal guardian who accepts these Terms and our Withdrawal Policy on your behalf.
(3) You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Enable two-factor authentication where offered.
(4) The Operator may refuse registration, suspend, or terminate accounts for breach of these Terms, abuse, fraud, legal requirements, or operational reasons.
(5) Optional sign-in via Discord is subject to Discord’s terms and privacy policy in addition to ours.
§ 4 Use of the Service and conduct
(1) You may use the Service for lawful personal (or, where applicable, commercial advertising/creator) purposes only.
(2) You must not:
- circumvent download limits, authentication, or security measures;
- scrape or overload the Service without permission;
- upload or distribute malware, illegal content, or material that infringes third-party rights;
- impersonate others or misrepresent affiliation with airlines, manufacturers, or rights holders;
- use the Service to harass, defame, or harm others.
(3) The Operator may remove content, throttle access, or report unlawful activity to authorities.
§ 5 Downloads, guest access, and content licence
(1) Signed-in and guest users may download published liveries and packs subject to technical limits. Guest users are subject to a daily download quota enforced via an HttpOnly cookie (mp_guest_dl) and related server-side measures (see Privacy Policy).
(2) Unless a separate licence is stated on a specific item, published liveries and packs are provided “as is” for use with MSFS. You are responsible for:
- complying with Microsoft / Asobo and third-party aircraft add-on licences;
- ensuring your use complies with applicable law and third-party branding or trademark restrictions.
(3) Downloading does not transfer ownership of livery artwork or trademarks depicted. Republishing, selling, or sublicensing downloaded content may be restricted by the creator, applicable law, or third-party rights.
(4) The Operator does not warrant that any livery will work with your simulator configuration or that depicted airlines or manufacturers have authorised fan liveries.
§ 6 Supporter Plan (subscriptions and lifetime)
(1) The Supporter Plan offers benefits such as ad-free browsing while signed in with an active plan (exact benefits are described on the Support page at the time of purchase).
(2) Prices, billing intervals (e.g. monthly, quarterly), and lifetime options are shown before checkout. Prices include applicable VAT where shown.
(3) Payment processing is handled by Stripe acting as Merchant of Record (Managed Payments). The Operator does not store full payment card numbers. Contractual payment terms are also subject to Stripe’s checkout terms where applicable.
(4) Recurring subscriptions renew automatically until cancelled in accordance with the flow provided at purchase (e.g. Stripe customer portal or account billing page). You may cancel future renewals; access typically continues until the end of the paid period.
(5) Lifetime or one-time Supporter products grant the described benefits for the lifetime of the Service or as specified at purchase, subject to section 14 (changes and termination).
(6) Consumers in the European Union have a statutory right of withdrawal for distance contracts. For digital content and services delivered immediately, this right may expire early if you expressly consent to immediate performance and acknowledge loss of withdrawal rights — as implemented in our checkout and Withdrawal Policy. Please read that policy before purchasing.
(7) Refunds are handled according to statutory rules, Stripe/MoR processes, and our withdrawal policy unless we expressly agree otherwise in writing.
§ 7 Ad Credits and advertising
(1) Ad Credits are prepaid units used to book advertising placements on the Service. Purchase and use of Ad Credits is governed by these Terms and the Advertising Agreement and Advertising Guidelines, which you must accept when enabling advertiser features.
(2) Ad Credits are digital goods. Withdrawal exclusions for immediately supplied digital content apply as set out in the Withdrawal Policy.
(3) The Operator may refuse, pause, or remove campaigns that violate the Advertising Agreement, law, or platform standards.
§ 8 Creator uploads
(1) Uploading liveries, maintaining a public creator profile, or using creator dashboard features requires acceptance of the Creator Agreement.
(2) Creators remain responsible for rights in their uploads. The Operator may review, reject, unpublish, or remove content under the Creator Agreement.
(3) In case of conflict between these Terms and the Creator Agreement regarding creator-specific matters, the Creator Agreement prevails for creators.
§ 9 Intellectual property
(1) Project Mega Pack name, logos, website design, software, and Operator-provided materials are protected. Riverbed LLC owns the Project Mega Pack brand; the Operator uses it under licence. You may not copy or misuse branding except as permitted by law.
(2) User-generated content remains the responsibility of the respective uploader or rights holder. By publishing content through creator features, you grant the licences described in the Creator Agreement.
(3) If you believe content infringes your rights, contact legal@garmingo.com with sufficient detail to identify the material and your claim.
§ 10 Availability, maintenance, and changes
(1) We may perform maintenance, updates, or changes that temporarily limit availability.
(2) We may modify features, limits, or catalog organisation for the future where legally, technically, or operationally required. Material adverse changes to paid subscriptions will be communicated where required by law.
§ 11 Liability
(1) The Operator is liable without limitation for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit), for injury to life, body, or health, and under the Product Liability Act (Produkthaftungsgesetz).
(2) For slight negligence, the Operator is liable only for breach of essential contractual obligations (Kardinalpflichten), and then limited to foreseeable, typical damage. Essential obligations are those whose fulfilment enables the contract and on which you may rely.
(3) Otherwise, liability is excluded to the extent permitted by law. Liability for lost profits, indirect damage, or data loss is excluded except where paragraphs (1) or (2) apply.
(4) Free use of browsing and guest downloads is at your own risk. Downloaded files should be scanned with up-to-date antivirus software.
(5) The above limits apply equally to legal representatives and vicarious agents of the Operator.
§ 12 Term and termination
(1) These Terms apply for the duration of your use of the Service.
(2) You may stop using the Service at any time and may request account deletion via support@garmingo.com where available.
(3) The Operator may terminate or restrict access for breach, inactivity, legal requirements, or discontinuation of the Service. Paid entitlements will be handled according to law and the relevant purchase terms.
§ 13 Privacy
Personal data is processed as described in our Privacy Policy. By using the Service, you acknowledge that information will be processed as stated there, including access by Riverbed LLC as brand owner and use of subprocessors (hosting in Germany, CDN/storage via bunny.net, payments via Stripe).
§ 14 Third-party services and links
The Service integrates or links to third parties (e.g. Stripe checkout, Discord OAuth, Bunny CDN delivery, external websites in creator profiles). Their terms and privacy policies apply in addition to ours.
§ 15 Governing law, jurisdiction, and language
(1) These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If you are a consumer with habitual residence in the EU, you benefit from mandatory provisions of the law of your country of residence.
(3) If you are a merchant (Kaufmann), legal entity under public law, or special fund under public law, exclusive place of jurisdiction for disputes arising from these Terms is Bochum, Germany, where permitted.
(4) These Terms are written in English. Company disclosures in the Imprint are also provided in German; where German law requires German wording for mandatory information, the German Imprint prevails for those disclosures.
§ 16 Miscellaneous
(1) If a provision is invalid, the remainder stays in effect; the invalid provision shall be replaced by one that closest reflects the economic intent.
