Creator Agreement

§ 1 Parties and scope

(1) The livery and creator platform “Project Mega Pack” (the “Platform”) is operated by

(the “Provider”).

Riverbed LLC (United States) is the brand owner of Project Mega Pack. The Provider operates the Platform under licence; Riverbed LLC may access personal data processed in connection with the Platform, as described in our Privacy Policy.

(2) The “Creator” is the natural or legal person who enables creator features on a Platform account and uploads liveries or maintains a public creator profile.

(3) This Creator Agreement (including these terms) governs access to creator tools, uploads, review, publication, and public creator pages (enabled by default when creator access is granted; the Creator may disable the public page in account settings). Conflicting Creator terms do not apply unless the Provider expressly agrees in writing.

(4) The Creator may be a consumer (§ 13 BGB) or entrepreneur (§ 14 BGB). Mandatory consumer rights remain unaffected where applicable.


§ 2 Subject matter

(1) The Provider enables Creators to upload aircraft liveries, manage drafts, submit them for technical and content review, and — after approval — distribute them via the Platform catalog and download flows.

(2) When creator access is enabled, a public profile page at /u/<username> is turned on by default, showing bio, social links, and published liveries. The Creator may disable the public page at any time in account settings (opt-out).

(3) The Provider does not guarantee downloads, reach, ranking, or revenue. Visibility depends on catalog rules, search, and user behaviour.

(4) The Provider may change upload limits, review criteria, formats, and distribution mechanics for the future where legally, technically, or operationally required.


§ 3 Formation and enablement

(1) Creator access is formed when the Creator expressly accepts this Creator Agreement during onboarding and the Provider records acceptance (agreementAcceptedAt).

(2) The Provider may refuse enablement or suspend creator access in case of breaches, abuse, or doubts about identity or legality.

(3) Uploading liveries or using creator dashboard features requires active creator enablement on the account.


§ 4 Rights to liveries and licence

(1) The Creator retains ownership of their liveries and related materials they upload.

(2) By uploading and publishing, the Creator grants the Provider a simple, worldwide, non-exclusive licence to store, process, validate, display, distribute, promote, and create thumbnails/previews of the liveries on and through the Platform for the purpose of operating the service.

(3) The Creator warrants that they own or have all rights necessary for upload and publication and that publication does not infringe third-party rights (including copyright, trademark, aircraft manufacturer branding, or airline liveries where restricted).

(4) The Creator shall not upload malware, corrupted archives intended to harm systems, or content that violates applicable law.


§ 5 Content rules and review

(1) Liveries must meet technical requirements (format, size, archive structure) published on the Platform.

(2) Prohibited content includes illegal material, malware, hate speech, glorification of violence, and content that infringes third-party rights. Liveries impersonating real airlines or manufacturers without permission may be rejected.

(3) New uploads and material changes to published liveries pass through a review pipeline (draft → validation → staff review → accepted or rejected). Review is limited and does not certify legal compliance of every detail.

(4) The Provider may reject, unpublish, or remove liveries that breach this Agreement, third-party rights, or law, or after user reports and investigation.

(5) Rejection reasons may be communicated in the dashboard. The Creator may revise and resubmit where the workflow allows.


§ 6 Public creator profile

(1) A public creator page is optional. When creator access is enabled, it is on by default until the Creator disables “Show public creator page” in account settings.

(2) Profile content (bio, links, images) must be lawful and must not mislead users about affiliation with the Provider or third parties.

(3) Disabling the public page or terminating creator access hides the profile URL; published liveries may remain in the catalog according to their individual status.


§ 7 Creator responsibility and indemnity

(1) The Creator is solely responsible for the content they upload and profile information they publish.

(2) The Creator shall indemnify the Provider and its agents against third-party claims arising from uploaded liveries or profile content, and reimburse necessary defence costs, to the extent the Creator is at fault. The Provider will notify the Creator promptly of claims.

(3) The Creator is responsible for any labelling or competition-law obligations applicable to their own promotions linked from their profile or liveries.


§ 8 Provider duties and availability

(1) The Provider aims for continuous availability of upload, review, and download flows. Maintenance, third-party outages (hosting, CDN, storage), or force majeure may limit service without compensation claims, except for intent or gross negligence by the Provider.

(2) Upload quotas and uploadBanned staff actions may limit or block uploads separately from this Agreement.


§ 9 Liability

(1) The Provider is fully liable for intent and gross negligence and for injury to life, body, or health.

(2) For slight negligence of material contractual duties (cardinal duties), liability is limited to foreseeable, typical damage.

(3) Other slight negligence liability is excluded. Product Liability Act claims and mandatory consumer rights remain unaffected.

(4) The Provider is not liable for third-party simulators, mods, or how end users install or use liveries.


§ 10 Data protection

The Platform Privacy Policy applies. Where the Creator receives personal data via analytics (e.g. download counts), they process it according to applicable law.


§ 11 Term, termination, and suspension

(1) Creator access runs while enablement is active on the account.

(2) The Creator may stop using creator features; the Provider may suspend or revoke creator access for cause, especially breaches of this Agreement or repeated rejections for policy violations.

(3) Account termination or upload bans may end creator access. Published liveries may be removed or retained at the Provider’s reasonable discretion and legal obligations.


§ 12 Amendments

The Provider may amend this Agreement for future effect where legally, technically, or operationally required. Material changes will be announced appropriately (e.g. in-product or email). If the Creator does not object within 30 days and continues using creator features, the change is deemed accepted where permitted by law; the notice will say so.


§ 13 Final provisions

(1) German law applies, excluding the UN CISG.

(2) If the Creator is a merchant, public-law entity, or special public fund, exclusive venue is Witten, Germany. The Provider may also sue at the Creator’s general venue. For consumers, statutory venue rules apply.

(3) If any clause is invalid, the remainder stays in force. An effective clause closest to the economic purpose replaces the invalid one.

(4) Amendments require text form (including email or express in-product acceptance) unless stricter form is mandatory.
